Endo International and Arnold Porter Opioid Discovery Abuses

As opioid addiction and death escalate, defense counsel conceals the evidence.

Endo International’s opioid defense counsel Arnold & Porter,  is facing  civil contempt charges in the New York state court opioid trial currently underway In Re Opioids Litigation, Suffolk County Supreme Court Justice Jerry Garguilo. Reflecting the gravity of the issue, Arnold & Porter has hired lawyers from three powerhouse commercial firms including Steptoe & Johnson, Pillsbury Winthrop Shaw Pittman and Robert & Robert, as well as Endo’s counsel Mayer Brown claiming “it’s just an oversight.”

Judge Garguilo signed an order to show cause August 11, on why Arnold & Porter and its client Endo Pharmaceuticals should not be help for contempt. Garguilo ordered both Endo and their trial counsel to appear on the show cause order on August 25.

This major discovery abuse was discovered in another state court opioid case, in Tennessee, where under agreed multi-district litigation (MDL) rules, various jurisdictions overseeing opioid cases have agreements in place that discovery in one jurisdiction, counts as discovery in others dockets. The State of New York, Nassau and Suffolk Counties  filed a motion to show cause for default judgment and other relief based on the discovery dispute.
